Wrongful Termination Lawyers
Wrongful termination describes a situation where an employee is terminated unlawfully. Typically, this means they were let go “without cause” and not given a fair or reasonable severance package.
After hearing about the specific nature of your case, the wrongful termination lawyers at Haber Lawyers will determine whether or not your termination was lawful, and discuss the options available to you moving forward. Most often we will commence a negotiation with your employer to ensure that you receive a fair and legal termination package. Sometimes, we will recommend commencing legal proceedings immediately when warranted by the situation.
The minimum notice (or pay in lieu) and severance pay that an employee can receive in Ontario is governed by 2 pieces of legislation. Provincially regulated industries (the majority of cases) are covered by the Employment Standards Act, 2000 (“the ESA”), while federally regulated industries (banking, telecommunication, mining, others) are covered by the Canada Labour Code. Employees are often entitled to common law notice, which is often much greater than the minimums mandated by legislation.
If you are unsure about your situation, Haber Lawyers has developed a Severance Pay Calculator as a guide to help determine the termination package you may be entitled to. An employment lawyer from Haber Lawyers will explain the results to you, and answer any questions you may have.
If you have arrived here because you have recently lost your job or you are expecting to be terminated, it is imperative that you not sign any termination paperwork without first having it reviewed by an employment lawyer. Too often, employees make rash decisions that can jeopardize their potential for a future settlement because they are pressured or misled by employers, and do not fully understand this complicated area of law.
